The current economic downturn has predictably brought about a substantial increase in the level of bad debts, with all the accompanying, and sometimes substantial, legal costs necessary to resolve the issue through a traditional county court judgment. For this reason, Hargreaves Mounteney Solicitors advises its clients to issue a Statutory Demand, which makes the successful collection of a debt markedly simpler and cheaper. In short, a Statutory Demand gives a debtor 21 days in which to pay a debt, after which a creditor can file for a bankruptcy petition. This ‘shotgun warning’ is so successful that in 99% of cases the debtor, rightly alarmed by the fear of being made bankrupt, promptly pays up.
