Employment Agent Terms


The running of an Employment Agency is subject to extensive statutory and case law. It is particularly important to distinguish between agency employment services and what amounts to advertising services. The restrictions and regulations that apply to agencies that provide workers (rather than those who merely introduce candidates) are strict and generally regarded as onerous. There are also restrictions to avoid, for example, an introduction agency cannot normally charge candidates for possible interviews - although there are certain matters for which charges can be made (e.g. CV services).

There is a long tradition of clients seeking t avoid paying employment agents, more than almost any other contract we encounter. We recommend Employment Agents provide very clear terms relating to:

  • How payment obligations arise (i.e. contract formation)
  • Payment trigger events
  • Payment amounts
  • Any refund terms offered.

Our internet Employment Agency Contract service is specifically aimed at Employment Agents dealing with candidates and employers via the internet and other Distance Selling methods, i.e. rather than 20th Century methods (on business premises, physical meetings, with wet-ink signatures on paper). Care needs to be taken over the statutory information requirements and rights of cancellation created under the Distance Selling Regulations need to be dealt with. All Employment Agencies setting up internet operations will require our contract service.

Our Employment Agency contract service give you two contracts in one package, the first aimed at your retention of candidates for your applicant pool; the other for the principals / clients / employers who will be your revenue stream.

How long will it take?

The time our work takes to conclude will depend on precisely what we are asked to do, but we would generally expect to have taken your instructions within two days of you having bought this product. We would normally expect to have produced a useable template within 4 working days. Special dispatch may be available where necessary at an extra charge.

Our work for you includes:

  • Ascertaining from you the full circumstances
  • Preparing two appropriate Employment Agency Agreement templates (one for candidates and one for principals/clients)
  • Advising on the negotiation and execution of those forms
  • Offering advice and support throughout the process.

Money Matters

Our work will be charged at a fixed fee of £575 including VAT.

Our fee applies regardless of how much work we actually do. In some cases this may mean we’ll get relatively better paid for doing less work than in other cases, in which the fixed fee will barely cover our costs. This is simply the nature of the mutual gamble between a solicitor and their client when they fix a fee.
