What is a Certificate of Independent Legal Advice?

A Certificate of Independent Legal Advice can be taken as evidence that you’ve sat down with one of our solicitors and discussed any property process risks. It might have to be shown to a lender, particularly if you’re entering into a joint borrower sole proprietor mortgage or there are conflicts of interest.

A Certificate of Independent Legal Advice might also be required if:

  • You’re looking to secure a corporate loan with a personal guarantee
  • A personal guarantee is being offered on your behalf or another party has requested that you secure a loan on their property
  • You’re transferring equity from a jointly owned property to a property to be owned in your sole name

The lender won’t be able to proceed until seeing the certificate as part of the duty to protect you against undue influence. They will also want to ensure that a loan is only issued if a guarantee is given by someone able to pay back the debt.
