What are trade marks?

A trade mark is a sign that distinguishes the goods or services of one business from those of others—this can include words, logos, slogans, shapes, colours and even sounds.

Official registration of a trade mark grants you exclusive rights to use it for the goods and services for which it is registered, providing legal protection against misuse by others.

What are the benefits of trade mark registration?

Registering a trade mark offers numerous benefits. Firstly, it gives you exclusive rights, providing you with a legal monopoly on the use of the trade mark within the registered jurisdiction. This exclusivity enhances brand recognition and consumer trust, as customers can easily identify and distinguish your products from those of competitors.

Additionally, trade marks are valuable intangible assets that can significantly increase your business’s value, offering protection against unfair competition and misuse of your brand.

Finally, a registered trade mark provides a strong basis for legal recourse, enabling you to take action against any infringement.

Trade marks provide offensive and defensive strategies for protecting your brand. A registered trade mark allows you to take legal action against unauthorised use, preventing others from capitalising on your brand’s reputation.

How long does the registration process take?

Trade mark registration times can vary by jurisdiction. In the UK, registrations typically take around 2.5 months from start to finish. EU and US registrations are generally faster, taking about half the time of UK registrations. Our efficient process ensures timely completion, keeping you informed every step of the way.

This time frame allows us to ensure all necessary details and legal requirements are thoroughly addressed. At Mounteney Solicitors, we prioritise efficiency and accuracy to meet our clients’ needs promptly and professionally.
