Deed of Retirement and Appointment of Trustees
Preparing a deed to retire and appoint trustees, with HMRC trust registration updates.

Deed of Retirement and Appointment of Trustees
At Mounteney Solicitors, we assist with the legal process of retiring existing trustees and appointing new ones. We advise on the steps required, prepare the deed, oversee its completion, and assist with updating the trust registration with HM Revenue & Customs where needed.
When there is a change in trustees, it is important to document that change formally and involve all relevant parties. Clear documentation helps to prevent confusion or dispute, and ensures that the trust continues to be properly managed. This is particularly important where trust assets or responsibilities are being passed to new individuals.
We begin by reviewing the situation and confirming the correct legal basis for the change. We then draft the deed of retirement and appointment, guide you through the signing process, and provide support with updating the HMRC Trust Registration Service if the trust is registered.
Trust law can be technical, and handling trustee changes correctly is essential to avoid future complications. Our experienced team will help ensure the process is carried out properly, with clear advice every step of the way.

Money Matters
This service does not include updating property titles at HM Land Registry, which is charged separately (Transfer of Equity).
The fee may change if the trust structure is complex, there are multiple trustees or beneficiaries, the trust documentation is incomplete or inconsistent, urgent timescales are required, or additional advice is needed beyond preparing and completing the deed and (where applicable) updating HMRC. If anything falls outside the standard scope, we will explain this clearly and agree any revised fee with you in advance.
Deed of Retirement and Appointment of Trustees (£500)
Our fixed fee covers reviewing the proposed change of trustees, advising on the correct legal basis, drafting the Deed of Retirement and Appointment of Trustees, and guiding you through execution so the deed is properly signed and dated.
Where the trust is registered, we will also complete the associated update on the HMRC Trust Registration Service and confirm the outcome to you.
Your supplier is SRA-regulated Mounteney Solicitors, that charges VAT some customers may be able to reclaim.
