Transfer of Equity on Relationship Breakdown
We manage the legal transfer of shared property following a relationship breakdown.

Transfer of Equity on Relationship Breakdown
When a personal relationship ends, arrangements often need to be made regarding the continued ownership of shared property. At Mounteney Solicitors, we provide the legal service required to implement changes to property ownership in these circumstances, typically where there is a formal agreement between the parties or a Family Court order setting out what should happen.
Our role is to carry out the legal transfer of ownership in line with an existing settlement or court order, liaise with any mortgage lender involved, and ensure the updated position is correctly registered with HM Land Registry. This may involve securing the release of a party from existing mortgage obligations or navigating time-sensitive obligations set by the Family Court or agreement terms.
If you need a reliable, professional property law firm to handle a change of ownership following a relationship breakdown, we can help ensure the process is completed efficiently and in accordance with all legal requirements.
For our standard service regarding property ownership changes, please see our main Transfer of Equity page.
Our Team of Specialist Solicitors
Money Matters
While family lawyers resolve the financial division of assets, the implementation of these agreements regarding real estate requires a specialist property solicitor experienced in the technicalities of formal transfers.
We bridge this gap by executing the technical property transfer mandated by your settlement or Court Order. We focus exclusively on the conveyancing process, ensuring that complex requirements, such as the precise timing of funds and obtaining necessary consents from existing lenders, are handled correctly to finalise the separation of assets.
Transfer of Equity on Relationship Breakdown (£1,100)
We assess your circumstances and execute a Transfer of Equity for value in accordance with Family Court orders, including necessary coordination with mortgage lenders to adjust existing arrangements.
The fee covers acting for the spouse transferring the property; fees for the spouse receiving the property may be higher depending on the circumstances.
Please note that while this service does not include a full new mortgage or the removal of a co-ownership restriction from the title. We frequently find that adjusting existing lending arrangements is sufficient to complete the transfer without requiring a full refinance.
For standard property ownership changes, please see our main Transfer of Equity page.
Your supplier is SRA-regulated Mounteney Solicitors, that charges VAT some customers may be able to reclaim.
