Assent and Transfer (Combined Product)
At Mounteney Solicitors, we provide a combined service to help families carry out changes in property ownership following a death. This covers both the initial legal transmission of the property from the deceased and a further transfer where beneficiaries agree a different outcome, often involving payment.
This service combines the work involved in both an assent and a transfer of equity for payment at a significantly reduced rate. It offers a clear and efficient way to complete the legal process and reflect the arrangements agreed between family members.
In many cases, a will may leave a property to more than one person. The beneficiaries may agree that one of them should take full ownership in return for paying a sum to the others. There are also variations on this, including property swaps and other practical solutions.
We will review your situation, advise on the best steps to take, and prepare all required HM Land Registry forms. We manage the signing process, submit the application for registration, and report the result. While we do not handle the payment itself, we may be required to carry out Source of Funds checks where money changes hands.
This structured two-stage approach allows us to deal with the legal transmission first, and then complete the final transfer in line with the family’s agreement, all registered together in one application.

Our combined service covers the legal work needed to complete both stages in one HM Land Registry application. We will review the situation, advise on the most appropriate approach, prepare the required forms for the assent and the transfer of equity, arrange signature and execution, submit the application to HM Land Registry, progress it through to completion, and report the final registered position.
This service is designed for situations where beneficiaries agree a different final ownership outcome than the will or intestacy produces, such as a buy-out or property swap. We do not handle the payment itself, but we may need to carry out Source of Funds checks where consideration is involved.

This is a combination of assent of property and transfer of equity at more than a 50% discount.
Single Service - Assent of Property Fees (£600 + VAT)
Our fee, plus HMLR Fee (Scale 2), covers only the assent of property fees. This covers the legal work needed to register the change in ownership at HM Land Registry.
If this service is acting in relation to a Transfer of Equity where some payment is involved (for example, one party is buying out the other), our fixed legal fee is £700 + VAT, plus the HM Land Registry fee and any other applicable disbursements. We handle the transfer and registration, keeping the process clear and cost effective.
If this service is acting in relation to a transfer of equity as a result of relationship breakdown, our fixed legal fee is £900 + VAT, plus the HM Land Registry fee and any other applicable disbursements.
