Probate and Conveyancing
At Mounteney Solicitors, we provide a joined-up service for clients who need to sell a residential property as part of administering a deceased estate. Where we are already instructed in the probate process, we also handle the conveyancing for the sale, ensuring continuity, efficiency and clear communication throughout.
In many estates, selling a property to a third party on the open market is a necessary step. By managing both the probate and the conveyancing within the same legal team, we reduce duplication and help move the matter forward without unnecessary delay.
As part of this combined service, we offer a reduced fee on our residential property conveyancing service where the transaction arises from a matter in which we are already acting on probate. This provides a practical and cost-effective option for executors and administrators who want the reassurance of working with a firm that already understands the estate.

Money Matters
This is a 10% discounted rate for our Residential Sale conveyancing product for residential property conveyancing arising from estates for which we acted in the extraction of Probate.
The administration of a deceased estate will often entail the decision to sell residential property on the open market to an unconnected third party in exchange for money. Where we are instructed in the probate we are willing to act in the conveyancing subject to this discount, essentially as a probate marketing incentive.

Residential Sale Conveyancing (£950)
This conveyancing service is for our involvement representing the seller of what we define in our Property Brochure as a standard property, the extent of the service being what is mentioned in our Property Brochure.
In addition to our fee, there may be various other related expenses (“disbursements”) which we will need to pay on your behalf, these will vary depending on the transaction, but will need to be funded by you in advance. We will explain to you as soon as possible which disbursements are applicable to your transaction and what the costs will be.
Extract Probate (Under the Inheritance Tax Threshold) (£1,440)
This service is extracting probate for ‘excepted estates’, i.e. lower value estates valued under the Inheritance Tax threshold, or over that limit with spousal exemption, including submitting the relevant tax form (but without any estate administration). You will also need to pay the Government grant fee for Solicitor extractions (currently £300).
Extract Probate (Over the Inheritance Tax Threshold) (£2,880)
This service is for extracting probate for estates valued over the Inheritance Tax threshold, including submitting the relevant tax form (but without any estate administration). You will also need to pay the Government grant fee for Solicitor extractions (currently £300).
Your supplier is SRA-regulated Mounteney Solicitors, that charges VAT some customers may be able to reclaim.
